Bengaluru Flat Owners Demand Land Registration and Clarity on Maintenance Fees

Flat owners in Bengaluru are asking for the title deeds of the land where their apartments are built to be transferred to their associations through a registered conveyance deed. Many builders in Bengaluru and Karnataka are not following this legal requirement, allowing them to mortgage the land or start new projects even after selling the apartments.

According to Sections 11 and 17 of the Real Estate Regulatory Authority (RERA) Act, builders must execute a registered conveyance deed of the undivided proportionate title in common areas to the association of allottees within three months of getting the occupation or completion certificate. Many builders have not complied, leaving flat owners uncertain about their ownership rights.

This issue was highlighted during a session organized by the Bangalore City Flat Owners’ Association (BCFOWA). Over 30 members from different apartment associations attended, showing the widespread concern among flat owners.

A flat owner in Uttarahalli shared his frustration, noting that after paying Rs 60 lakh for his flat, he only has the sale deed to prove ownership, and his name is not on the encumbrance certificate. Another buyer in Whitefield questioned how to prevent new claims on the land without the conveyance of the title deed.

Flat owners are also concerned about maintenance charges for common areas. They question why they should pay these fees when the plot isn’t registered in their name. One resident stopped paying maintenance fees after not receiving a registration certificate, resulting in the builder cutting off her water and electricity. This issue is now in court.
